Terms of Service

The rules for using VOXA, including the free trial, billing and cancellation.

Effective date: October 23, 2026

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you and Nonlinear Platform Development, Montréal, Québec, Canada (“we”, “us”), the operator of mobilehealthcheck.online and the VOXA voice biomarker analysis service (the “Service”). By registering, starting a free trial, subscribing or using the Service, you agree to these Terms and to our Privacy Policy and Medical Disclaimer. If you do not agree, do not use the Service.

2. The Service

VOXA is a browser-based wellness and self-awareness tool. It analyses the acoustic properties of a voice recording you provide (and, optionally, facial micro-expressions in a short video) and presents reproducible indicators, together with an optional personalised relaxation soundscape. Your recordings stay on your device: the app converts them into numeric measurements in your browser, and those measurements are processed by VOXA's analysis engine to compute your results, as described in the Privacy Policy. Access requires a personal licence key, which we send you after you start your trial. We may improve, change or discontinue features from time to time; if we discontinue the Service as a whole, we will give subscribers reasonable notice.

3. Not a medical device; not medical advice

The Service is not a medical device and is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition. Its outputs are estimates derived from voice acoustics, not laboratory measurements, clinical tests or diagnoses, and they may be inaccurate. Do not use the Service in an emergency, and never disregard professional medical advice or delay seeking it because of anything the Service shows. The full Medical Disclaimer forms part of these Terms.

4. Eligibility and your registration

  • You must be at least 18 years old and able to form a binding contract.
  • You must provide accurate, current and complete registration details (first name, last name, country, phone number and e-mail address) and keep them up to date.
  • Your subscription is personal to you. You may not share or resell access.
  • You are responsible for activity under your subscription and for keeping your access details confidential.

5. Free trial and subscription

  • Free trial. New subscribers receive a 30-day free trial. You will be asked for a payment method at checkout, but you will not be charged during the trial. One trial per person.
  • Automatic renewal. Unless you cancel before the trial ends, your subscription converts automatically into a paid monthly subscription at $99 per month (in the currency shown at checkout, plus any applicable taxes), charged on the day the trial ends and then every month on the same date until you cancel.
  • Billing. Payments are processed by Stripe. You authorise us, through Stripe, to charge your payment method for each billing period. If a payment fails, we may retry it and may suspend access until it succeeds.
  • Reminders. We will send a reminder to your e-mail address before your trial ends.
  • Price changes. We may change the subscription price for future billing periods by giving you at least 30 days' notice by e-mail. If you do not agree, you may cancel before the change takes effect.
  • Taxes. Applicable sales taxes (such as GST/HST/QST or VAT) are calculated at checkout. Where the law requires prices to be shown including tax — for example VAT for consumers in the EU and UK — the total including tax is shown before you confirm.

6. Cancellation

You can cancel at any time using the Cancel subscription form (linked at the bottom of every page), by e-mailing support@mobilehealthcheck.online from the e-mail address you registered with, or through any subscription-management link included in your Stripe billing e-mails. If you cancel during the free trial, you will not be charged. If you cancel after the trial, cancellation takes effect at the end of the billing period already paid, and you keep access until then. We confirm every cancellation by e-mail.

7. Payments are final

Because the first 30 days are free so that you can evaluate the Service before paying, all payments are final and non-refundable, including for partially used billing periods, unused time or features, except where a refund is required by the consumer-protection law that applies to you. Nothing in these Terms limits any non-waivable right you have under the law of your place of residence.

8. Acceptable use

You agree not to: (a) analyse another person's voice or face without their informed consent; (b) use the Service to make decisions about another person's employment, insurance, credit, housing, legal status or medical care; (c) present the Service's outputs as medical diagnoses or professional advice; (d) copy, reverse engineer, resell or redistribute the Service, except as permitted by law; (e) interfere with, overload or attempt to gain unauthorised access to the Service or our forms; or (f) use the Service for any unlawful purpose.

9. Intellectual property

The Service, its software, design, text, graphics and the VOXA name are owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial purposes while your subscription is active. Your recordings and results belong to you. Your recordings never leave your device, and the analysis engine does not keep the measurements or results it processes. Your licence key is personal: do not share it; we may deactivate keys that are shared or misused.

10. Third-party services

Checkout and billing are provided by Stripe under Stripe's own terms. Optional features inside the app that connect to outside services (such as public randomness or geomagnetic data services) are governed by those providers' terms. We are not responsible for third-party services.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that its outputs will be accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Service, or from any decision you make based on its outputs. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted. You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable there. Subject to any mandatory rights you have as a consumer to bring proceedings in the courts of your place of residence, the courts of the judicial district of Montréal, Québec, have jurisdiction. Before starting proceedings, please contact us so we can try to resolve the issue informally.

14. General

  • Termination. We may suspend or terminate access if you materially breach these Terms. You may stop using the Service at any time.
  • Changes. We may update these Terms. Material changes will be notified by e-mail at least 30 days before they take effect; continued use afterwards means you accept them.
  • Entire agreement and severability. These Terms, the Privacy Policy and the Medical Disclaimer are the entire agreement between you and us. If any provision is unenforceable, the rest remains in effect.
  • Language. These Terms are provided in English. A French version is available on request; the parties have expressly requested that these Terms be drawn up in English. Les parties ont expressément exigé que ces conditions soient rédigées en anglais ; une version française est disponible sur demande.
